1. Acceptance of Terms

By accessing or using the SB Estates LLC platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

SB Estates LLC provides a comprehensive property management platform serving three primary audiences:

Individual Property Owners: Self-manage properties with tools for rent collection, maintenance tracking, and tenant management.
Property Management Companies (Organizations): Manage multiple properties and owners with advanced features including managed owner accounts, organization-level billing, and team collaboration.
Renters: Access rental properties, submit payments, request maintenance, and view important property documents.

Our services include property listing, tenant management, rent collection, maintenance coordination, document signing, payment processing via Stripe, and organization-level subscription management.

3. User Accounts

To access certain features of our platform, you must register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Account Types:

Owner Accounts: Individual property owners or managed owners under a property management company.
Organization Accounts: Property management companies with administrative users who manage multiple owners and properties.
Renter Accounts: Tenants assigned to specific properties, created by property owners or management companies.

Organization accounts may have multiple administrative users. The organization is responsible for all actions taken by its team members.

4. User Conduct

You agree not to use our platform to:

Violate any applicable laws or regulations
Infringe on the rights of others
Post false, misleading, or fraudulent information
Harass, threaten, or intimidate others
Attempt to gain unauthorized access to our systems

5. Property Listings

Property owners are responsible for the accuracy of their listings. SB Estates LLC does not guarantee the condition, legality, or availability of listed properties.

6. Fees and Payments

We may charge fees for certain services. All fees are non-refundable unless otherwise stated. You agree to pay all fees and charges associated with your account on a timely basis.

Subscription Plans:

Individual Owners: Subscription plans are billed per owner and may include monthly or annual billing cycles.
Organizations: Subscription plans are billed per organization and include limits on the number of managed owners, properties, and administrative seats.
Trial Periods: We may offer free trial periods. At the end of a trial, you must subscribe to a paid plan to continue using the service.

Payment Processing: All payments are processed securely through Stripe. By using our payment features, you agree to Stripe's terms of service. We do not store any payment, credit card, or bank account information on our servers.

Rent Payments: Rent payments made by renters are subject to processing fees. For organization-managed properties, payments are routed to the organization's Stripe Connect account.

Maintenance Reserves & Security Deposits: Organizations may collect maintenance reserves and security deposits on behalf of property owners. These funds are held according to applicable state laws and regulations.

7. Organization-Specific Terms

For Property Management Companies:

You may create and manage owner accounts on behalf of your clients.
You are responsible for all activities performed by your team members and managed owners.
You agree to comply with all applicable property management laws and regulations in your jurisdiction.
You must maintain proper licenses and insurance as required by law.
You are responsible for handling security deposits, maintenance reserves, and rent payments in accordance with state and local laws.
You may upload documents for managed owners to sign. By doing so, you represent that you have the authority to request these signatures.

For Managed Owners:

Your account is managed by a property management company using our platform.
You authorize your property management company to create and manage properties, renters, and payments on your behalf.
You are responsible for paying setup fees, maintenance reserve requests, and any other fees charged by your property management company.

For Renters:

Your account is created by your landlord or property management company.
You agree to pay rent and any applicable fees on time through the platform.
You may view and sign documents uploaded by your landlord or property management company.

8. Document Signing

Our platform provides electronic signature functionality for lease agreements, addendums, and other property-related documents. By using our signature feature:

You agree that your typed name constitutes a legal electronic signature.
You acknowledge that digitally signed documents have the same legal validity as paper documents with handwritten signatures.
You understand that signed documents are stamped with your name, date, and time of signing.
You receive a copy of all documents you sign via email and can access them in your portal.

9. Termination

We reserve the right to terminate or suspend your account at our discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

Organizations may terminate managed owner or renter accounts at any time. Upon termination, all associated data, including security deposits and maintenance reserves, should be handled according to applicable laws.

10. Intellectual Property

All content on our platform, including text, graphics, logos, and software, is the property of SB Estates LLC and is protected by copyright, trademark, and other intellectual property laws.

11. Disclaimer of Warranties

Our platform is provided "as is" without any warranties, expressed or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free. SB Estates LLC does not guarantee the accuracy of information provided by property owners, management companies, or renters.

12. Limitation of Liability

SB Estates LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. We are not responsible for disputes between property owners, management companies, and renters.

13. Indemnification

You agree to indemnify and hold harmless SB Estates LLC and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of our services.

14. Data Privacy

We collect and process personal information in accordance with our Privacy Policy. Organization administrators may access information about managed owners and renters as necessary to provide property management services. By using our platform, you consent to this data sharing.

15. Governing Law

These Terms of Service shall be governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Property management companies must also comply with all applicable state and local laws in the jurisdictions where they operate.

16. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes by posting the new Terms on our platform and updating the "Last Updated" date. Continued use of the platform after changes constitutes acceptance of the new terms.
